The terms and conditions of sale apply to the purchase of goods between the customer (hereinafter: the Buyer) who has placed an order in the online environment polgent.ee (hereinafter: the Online Store) and the owner of the Online Store, Polgent-G OÜ, registry code 10259319, address Pärnu mnt. 142, Tallinn (hereinafter: the Seller).
1. General
1.1 The terms and conditions establish the rights and obligations of the Buyer and the Seller, as well as the conditions for the purchase, sale, payment, delivery, and return of goods.
1.2 In matters not regulated by these terms, the Seller and the Buyer shall be guided by the requirements arising from legislation.
1.3 In addition to these terms, the legal relationships arising from the purchase of goods from the Online Store are regulated by the legislation in force in the Republic of Estonia.
2. Product and Price Information
2.1 Information about the goods is provided directly next to the item. Product images are for illustrative purposes and may differ slightly (in color, etc.) from the actual product. Product descriptions may not be exhaustive and may contain unintentional inaccuracies. In case of doubt or to receive more detailed info, the Buyer shall contact OÜ Polgent-G via the provided contact details.
2.2 Selling prices are in euros and do not include VAT (Value Added Tax).
2.3 The Seller reserves the right to change prices at any time. If an order was placed before the change in terms or prices, the Seller shall deliver the goods at the prices valid at the time the order was placed.
2.4 A delivery fee is added to orders with a total value of less than €500. The fee depends on the package size and/or the delivery method chosen by the Buyer:
Omniva parcel machine €4, SmartPost parcel machine €5, DPD parcel machine €4, Venipak parcel machine €4, courier delivery €10.
The delivery fee is displayed to the Buyer during the checkout process. There is no delivery fee for the “I will pick it up myself” option; goods can be collected at Pärnu mnt 142, Tallinn, between 09:00–16:00.
3. Placing an Order
3.1 To order goods, the Buyer adds the desired items to the shopping cart, selects the payment and delivery methods, and fills in the required contact information fields.
3.2 After reviewing the order and having read these terms, the Buyer marks their agreement to the terms and confirms the order. An order confirmation, along with the terms of sale, will be sent to the Buyer’s email address.
3.3 Upon confirmation, the total amount due is displayed, which can be paid via internet bank, bank transfer, or card payment.
4. Entry into Force of the Sales Agreement
4.1 The sales agreement is considered concluded and enters into force upon receipt of the total amount due in the Seller’s bank account.
4.2 If the ordered goods cannot be delivered due to being out of stock or for any other reason, the Seller shall inform the Buyer at the earliest opportunity and refund the paid amount (including delivery costs) within two working days of sending the notice.
4.3 An order for which payment has not been received will be cancelled seven days after the order was placed.
5. Delivery
5.1 Orders placed in the Online Store are processed on working days (Mon–Fri 09:00–16:00). After the agreement enters into force (see 4.1), the Seller generally prepares the goods on the same or the following working day.
5.2 Goods are delivered within Estonia via partners: SmartPost, Omniva, DPD, Venipak, or courier services.
5.3 The delivery method depends on the size of the package and/or the destination chosen by the Buyer.
5.4 Average delivery time to a parcel machine or via courier is 2–4 working days from the moment the goods are handed over to the logistics partner.
5.5 In exceptional cases, if the goods are in the supplier’s (or manufacturer’s) warehouse, delivery may take 5–30 working days. The Buyer will be notified of the delivery period as soon as possible.
6. Right of Withdrawal
6.1 If the Buyer wishes to withdraw from the agreement after placing an order but before the Seller has fulfilled it, they must immediately notify the Seller via phone at +372 6556995 (Mon–Fri 09:00–16:00) or in writing to info@polgent.ee, including the order date, order number, and contact details.
6.2 After receiving the goods, the Buyer has the right to withdraw from the agreement concluded in the Online Store within 14 days without giving a reason. The right of withdrawal does not apply if the Buyer is a legal person (company).
6.3 To exercise the right of withdrawal, the goods must not be used in any way other than necessary to verify the nature, characteristics, and functioning of the goods in a manner permitted in a physical store. Returned goods must be undamaged, in their original packaging (opened carefully and without damage), and include all documents, accessories, and protective covers/films.
6.4 If the goods have been used for purposes other than those described in 6.3 or show signs of wear, the Seller has the right to reduce the refund amount in accordance with the decrease in the value of the goods.
6.5 To return the goods, the Buyer must submit a written withdrawal application within 14 days of receipt to info@polgent.ee or submit it at the office/warehouse at Pärnu mnt 142, Tallinn.
6.6 Upon withdrawal, the Buyer must return the goods within 14 days of submitting the application, either by bringing them to the warehouse by prior agreement or by providing proof of handing the goods over to a logistics company.
6.7 The costs of returning the goods are borne by the Buyer, except if the goods do not match the order (e.g., wrong or defective product).
6.8 The Seller shall refund all payments received from the Buyer under the agreement immediately, but no later than 14 days after receiving the withdrawal application.
6.9 The Seller may refuse to make the refund until the goods have been received back or until the Buyer has provided proof of returning the goods, whichever occurs earlier.
7. Right to File a Complaint
7.1 The Seller is liable for any lack of conformity or defects in the goods sold to the Buyer that appear within two years of delivery. During the first year, it is presumed that the defect existed at the time of delivery; the Online Store bears the burden of proof to rebut this presumption.
7.2 Upon discovering a defect, the Buyer has the right to contact the Seller within two months by emailing info@polgent.ee or calling +372 6556995. The notice should include the Buyer’s name, contact details, order/invoice number, and a description/photo of the defect.
7.3 The Seller is not liable for defects that occur after the goods have been delivered to the Buyer.
7.4 If the product has defects for which the Seller is responsible, the Seller shall repair or replace the defective goods.
7.5 If repair or replacement is not possible, the Seller shall refund all fees associated with the sales agreement.
7.6 All complaints will be reviewed, and the Seller will contact the Buyer as soon as possible, but no later than 14 days after receiving the complaint.
8. Processing of Personal Data
8.1 The Seller uses the Buyer’s personal data (name, phone number, address, email) only to process the order and transmits necessary data to logistics partners for delivery.
8.2 The Seller sends newsletters or offers to the Buyer’s email only if the Buyer has given separate consent on the website.
8.3 The Buyer can opt-out of offers and newsletters at any time by notifying via email or following the instructions in the email.
8.4 Encrypted data communication with banks during payment ensures the security of the Buyer’s personal banking credentials; the Seller has no access to them.
9. Settlement of Disputes
9.1 The Seller is liable for any lack of conformity or defects in the goods sold to the Buyer that appear within two years of delivery.
9.2 Upon discovering a defect, the Buyer has the right to contact the Seller within two months by presenting the invoice for the purchase.
9.3 Disputes arising from the purchase of products through the Seller shall be resolved through negotiations.
9.4 If the Seller has refused to satisfy the Buyer’s complaint or if the Buyer does not agree with the solution offered by the Seller, the Buyer may turn to the Consumer Disputes Committee. The procedural rules can be reviewed and an application submitted at https://komisjon.ee.
9.5 The Consumer Disputes Committee has the competence to resolve disputes arising from the agreement concluded between the Buyer and the Seller. The review of the Buyer’s complaint by the Committee is free of charge.
9.6 In addition to the above, the Buyer has the right to turn to the European Union Online Dispute Resolution (ODR) platform to resolve any disputes that have arisen.
